An example would be that colleges met the requirements of the part-time workers regulations. National agreements must be agreed locally at a college and branches can negotiate further improvements on what was agreed nationally. There are separate bargaining arrangements in Wales and Northern Ireland so agreements reached with the Association of Colleges only apply in England. UCU does not organise FE staff in Scotland. HE In higher education, nationally we negotiate your pay and some employment conditions through an academic sub-committee of the Joint National Committee for Higher Education Staff. UCU local associations and branches negotiate with individual employers on the implementation of nationally agreed pay structures and nationally agreed conditions of employment, and all other employment issues. Four year rule  if you have been on two or more successive ftc with same employer for 4 years you can consider yourself permanent The use of successive fixed-term contracts Part 2, regulation 8 The regulations limit the use of successive fixed-term contracts to a period of four years. Once a fixed-term employee has four years' continuous service on two or more contracts (or has had their contract renewed), the contract automatically becomes indefinite unless the continued use is objectively justified. Service prior to 10 July 2002 did not count towards this period of four years. There is no limit on the duration of a first fixed-term contract. But if a first fixed-term contract lasts for four years or more and is renewed, the second contract will be regarded as permanent (unless the continuing use of a fixed-term contract is objectively justified). The regulations provide for a collective or workplace agreement that will define both objective justification and / or the maximum total period an employee can remain on a fixed-term contract. This will allow local associations/branches to negotiate agreements for fixed- term staff that improve on the statutory minimum. Our position has now been vindicated in the case of Ball v Aberdeen University. Ball v Aberdeen (Employment Tribunal) 2008 Dr Ball had been continuously employed at the university under three successive contracts which began in April 1999. Each contract had been linked to external short term fixed-term funding. His third contract was for the period ending at the end of May 2008, and he was offered a fourth fixed term contract. When Dr Ball sought confirmation of his permanent status under the Regulations he was advised that as the University had no guarantee of further funding beyond the end date in his contracts they believed there was an objective justification to continue to employ Dr Ball on fixed-term contracts. The case was taken to tribunal who found that Dr Ball suffered genuine disadvantage in being kept on fixed-term contracts; uncertainty of future employment, disadvantage in terms of career progression and professional development, and potential difficulties in obtaining credit. These disadvantages were not outweighed by the disadvantages claimed by the university in employing Dr Ball on a permanent basis. These included the difficulty in using the redundancy procedure (which should have been applied to fixed-term researchers in Aberdeen in any case). Consequently, the tribunal found that the university could not establish objective grounds for continuing Dr Ball s employment on a fixed term basis. The tribunal rejected the university s case that short term funding could automatically provide a justification for employment on a fixed term, and found that the university had failed to carry out any assessment as to whether Dr Ball could have been offered a permanent contract in 2002 when his third contract was offered. Reading your contract of employment and any relevant policies will put you in a stronger position should you wish to raise any issues. As an hourly-paid member of staff you may have a permanent or open-ended contract, or your contract may be for a fixed-period of time. Your contract may specify the number of hours you will be required to work or this may vary. Equal pay for work of equal value Taking into account all the work carried out by hourly-paid staff and pay often not being linked to the pay of colleagues carrying out similar work, the hourly rate is usually inadequate. Often there is a comprehensive teaching rate for every hour of teaching that should cover other duties such as preparation, marking, administration, attending meetings. These rates are usually inadequate. The correct rate of pay can be determined by working out what proportion of a full-time job is being carried out. Advice here: http://bit.ly/gP9de2 You need to know your grade. If several staff are not on an identifiable grade it could be a collective issue that should be raised with your branch. If paid a comprehensive rate, you need to know how many hours are added to each paid teaching hour for associated duties and what duties you are expected to carry out for each hour s pay. Working for more hours than you are paid  unequal pay, unfair treatment, affect work-life balance and lead to stress. Pay rises for hourly-paid staff are often far less frequent than those received by colleagues, and incremental progression through a pay grade denied. Raise with your branch if this is the case. Holiday pay is often included in the hourly rate and calculated at the statutory minimum unlike the more generous holiday provision given to other staff. Leave entitlement should either be provided as paid leave or added to the hourly rate of pay and be clearly identified as holiday pay on your pay slip. Travel allowances  unlike some staff, hourly-paid staff often don t get any contribution towards travel Equality Your institution is legally obliged to address the need to eliminate discrimination, harassment and victimisations as well as advancing equality of opportunity. In FE, the national agreement states that such contracts should always specify a guaranteed minimum of contracted hours. It is UCU policy that variable hours should only be used in exceptional circumstances and only where there is a reasonable guaranteed minimum. The contract should not allow for hours to be reduced below the minimum guaranteed number without triggering the obligations on the employer that arise in a redundancy situation. Employers may try to use contracts that allow them to reduce hours year on year until there is little left  and little redundancy pay if the hours are eventually reduced to zero. This gives managers power to treat different groups of staff unequally  to the detriment of hourly-paid staff. In some cases you may have a contract that guarantees no work but specifies what you will be paid if you accept work that is offered. These types of contracts are known as zero hours contracts (they may also called  as and when or bank contracts). UCU has a firm policy against the use of such contracts as they offer no security of income for members and can lead to exploitation.  Permanent zero hours contracts actually enshrine job insecurity and make access to real job security under the fixed-term regulations difficult. If your contract is a variable-hours contract or some sort of zero hours contract then please make sure that your UCU branch and regional office are aware of this  it is important for UCU to know where these types of contracts are being used. However, this might not be correct in law. Whether you are employed or self-employed depends on the circumstances of your employment not simply because your employer states you are self-employed In law, employees have the most rights and self-employed have very few. The courts decide whether or not you are an employee. Factors include: the extent to which the employer decides what tasks the individual does and how they do them; how much the individual is part of the organisation; the extent to which the employer is required to offer the individual work and whether they are required to do it; whether the individual can decide whether they do the work. Definitions of worker and employee vary. When referring to the law, it is important to see who the specific legislation covers. In Carl v Sheffield University, Kaye Carl fought a long case and succeeded in demonstrating that she was an employee  even though she was on a contract for services rather than a contract of employment./.. Also, solicitors always recommend that reaching agreements by your union negotiating with your employer is the most effective way to make improvements for you. Using the law can be a gamble as you can never be guaranteed of getting the right verdict. It can be stressful, long-winded and is expensive. However, where it is in our members interests to take a case, we will do so and we have an excellent legal scheme that can provide support in taking a case to an employment tribunal. You need to get in touch with your local association or branch and they will contact your regional office. The details are on our website but it is important to point out that unless you join UCU as soon as you start in qualifying employment (or within 30 days) in which case there is no qualifying period to apply for legal services, normally you need to be a member for 90 days before you request legal support and your problem must have occurred after this waiting period. Unless there are significant reasons why UCU should take up the case, possibly when it is a major issue that affects the wider UCU membership. UCU member Sue Birch used the Part-Time Worker Regulations to challenge her hourly rate of pay and, with support from UCU won her case. She was doing similar work to that of a comparable full-time lecturer but earned 10,000 less. Her employer, Leeds Metropolitan University, settled the case after the court agreed Sue could compare herself to a full-time lecturer. As a result she was awarded compensation and a permanent full-time contract. Many cases don t reach an ET as they are settled by the employer. In UCU v Lancaster University, a case was taken by UCU under S189 of the Trade Union and Labour Relations (Consolidation) Act 1992 for a failure to consult with the trade union in a collective redundancy situation. The Act requires employers to consult with the recognised trade unions whenever there is the possibility of 20 or more redundancies in a 3 month period. The employer did not engage in consultation over the potential redundancies of FTC staff but merely sent lists to UCU of those whose contracts were due to expire within the given period. They were also providing some other limited information and were consulting with the individual members concerned. However, despite repeated requests, the employer failed to provide the necessary information to the UCU or to meaningfully consult with UCU over the proposed redundancies. The employer argued that the legislation was not intended to be used for FTC situations and that the it was up to the union to raise concerns when the lists were sent to them. The tribunal found that: The lists of staff whose contracts were due to end were effectively intimations of an intention to make those employees redundant therefore the duties to provide information to UCU and to consult with UCU applied. Serving notice by way of the list and leaving it to the union to raise issues was an  impermissible approach to meeting the duty to consult. There were no special circumstances that rendered it not reasonably practicable to comply with the legal requirements. The tribunal found in favour of UCU. Lancaster University appealed the Employment Tribunal s decision to the Employment Appeal Tribunal but the EAT agreed with the tribunal that there was a serious breach in terms of failure to consult and to supply the required information  despite reminders from the union. Legally-binding as an Employment Appeal Tribunal judgement. The university was made to pay two months salary to each of the ftc staff that were made redundant. This was a significant victory for UCU and is now being used to encourage employers to negotiate redundancy avoidance agreements that include ftc staff at a number of universities. Stirling The duty of employers to consult the recognised trade union and supply specified information in the case of collective redundancies; 20 or more proposed redundancies in a period of 90 days or less (Trade Union and Labour Relations (Consolidation) Act) applies only where the dismissal as redundant is a dismissal for a reason not related to the individual concerned or for a number of reasons all of which are not so related. The Employment Appeal Tribunal (Scotland) has ruled that the university s reason for dismissal was that the employees in question had agreed to their contract being of limited duration, therefore the employees were dismissed for a reason relating to them as individuals and thus were not dismissed as redundant within the meaning of this part of TULR(C)A. Accordingly, there was no duty to consult with UCU under section 188 of the Act. UCU believes this decision is wrong and at considerable variance with both existing practice and legal commentary on the statutory provisions. UCU is seeking leave to appeal against the. In the meantime, there are likely to be some employers who will try and use the case in arguing against the need to formally consult on threatened redundancies where those affected are on fixed-term contracts. All tutors will be offered fractional contracts with guaranteed hours and conditions of service based on those of equivalent full-time lecturers. Strong campaigning including bringing collective grievances at the College of North East London resulted in staff being moved to pro-rata contracts. Targeted departments and walked around talking to postgraduates who teach, a pay survey revealed differences, made improvements in pay and conditions in some departments. Successes also come in terms of getting agreement from the employer to receive contact details for hourly-paid staff for the purposes of recruitment. They sometimes say they don t hold this information (but if employed then finance dept must have details) or that it lies with the departments, in which case an approach can be made to departments. Some branches such as Durham have had success in getting an HP staff list by explaining thatthey could collect information available from the university website.
